Terms and Conditions

1. Scope

These Terms and Conditions (hereinafter "T&Cs") apply to all orders placed by consumers within the meaning of § 13 of the German Civil Code (BGB) through our online shop ergolea.de. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

3. Offer and Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding invitation to submit an order (invitatio ad offerendum).

By clicking the order button ("Buy Now" / "Buy" / "Order with Obligation to Pay"), you submit a binding offer to conclude a purchase contract.

Before submitting your order, you can review and change your entries in the checkout at any time. Immediately after receipt of the order, you will receive an automatic order confirmation by email. This automatic confirmation merely documents receipt of the order and does not yet constitute acceptance of the contractual offer.

The purchase contract is concluded as soon as we accept your offer by an express declaration of acceptance (e.g. shipping confirmation) or by shipping the goods to you, at the latest upon delivery of the goods.

The contract language is German and English.

The contract text is not stored permanently by us and is no longer accessible through us after conclusion of the contract. The order data and our T&Cs will be sent to you by email; we recommend that you save or print these for your records.

4. Prices and Shipping Costs

All prices stated on our website are final prices and include statutory value-added tax (VAT) as well as all other price components.

In addition to the product prices, shipping costs may apply. The applicable shipping costs will be transparently displayed in the checkout before you place your order and are clearly identifiable before the conclusion of the contract.

5. Delivery and Shipping

5.1 Delivery Area We deliver to Germany, Austria, and Switzerland.

5.2 Delivery Time The delivery time is generally 7–14 business days from shipment of the goods, unless otherwise stated in the offer. Shipping days are Monday to Friday (excluding public holidays).

5.3 Shipping from Asia Our goods are shipped via our logistics partner from a warehouse in Asia (China). Please note:

  • In some cases, import duties (import VAT and/or customs duties) may apply, which are charged by the respective customs authorities in Germany, Austria, or Switzerland and which you would have to pay to the delivery service as the recipient. We work to avoid this through suitable shipping procedures but cannot guarantee it in every individual case.
  • For deliveries to Switzerland, import duties under Swiss law generally apply, which are to be borne by the recipient.
  • All products sold by ERGOLEA are CE- and RoHS-certified and comply with applicable European safety and environmental standards.

5.4 Transfer of Risk When goods are shipped to a consumer, the risk of accidental loss and accidental deterioration of the sold item passes to the consumer only upon delivery of the goods to the consumer, in accordance with § 475 (2) BGB.

6. Payment

The following payment methods are generally available (the payment methods available in individual cases will be displayed in the checkout):

The purchase price is due for payment upon conclusion of the contract. In the event of late payment, the statutory provisions apply.

7. Right of Withdrawal and 90-Day Money-Back Guarantee

7.1 Statutory Right of Withdrawal Consumers have a statutory right of withdrawal of 14 days. The detailed conditions, withdrawal instructions, and the model withdrawal form can be found in our separate Withdrawal Instructions.

7.2 Voluntary 90-Day Money-Back Guarantee In addition to the statutory right of withdrawal, we grant you a voluntary 90-day money-back guarantee. The conditions can also be found in our Withdrawal Instructions. This voluntary additional service complements your statutory rights and does not restrict them.

7.3 Exclusion from the Right of Withdrawal – Hygiene Items Excluded from the right of withdrawal pursuant to § 312g (2) No. 3 BGB are sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. This includes, for example, insoles, bandages, or products with direct skin contact, if they have already been used or if the packaging has been opened or the hygiene seal damaged.

7.4 Return Returns are sent to our warehouse in Asia. Return shipping costs are typically between €10 and €30 and are to be borne by the buyer, unless otherwise regulated in the Withdrawal Instructions (e.g. in the case of damaged, defective, or incorrectly delivered goods).

To initiate a return, please contact us in advance by email at support@ergolia.de, stating your order number. We will then inform you of the next steps and the exact return address.

8. Warranty (Liability for Defects)

The statutory provisions on liability for defects pursuant to §§ 434 et seq. BGB apply. The limitation period for warranty claims for newly manufactured items is two years from delivery of the goods.

In the event of a defect in the goods, you are first entitled to subsequent performance (repair or replacement at your choice). If subsequent performance fails, you may, in accordance with statutory provisions, reduce the purchase price, withdraw from the contract, or claim damages.

Please report defects to us as soon as possible at support@ergolia.de, ideally stating the order number and providing photos of the defect. Failure to do so does not affect your statutory warranty rights.

9. Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

10. Liability

10.1 Unlimited Liability We are liable without limitation:

  • for injury to life, body, or health resulting from an intentional or negligent breach of duty by us or our legal representatives or vicarious agents;
  • for other damages based on an intentional or grossly negligent breach of duty by us or our legal representatives or vicarious agents;
  • for breach of a guarantee assumed by us or a guarantee of quality;
  • for claims under the German Product Liability Act (Produkthaftungsgesetz).

10.2 Limited Liability In the event of slightly negligent breach of a material contractual obligation (cardinal obligation), the performance of which makes the proper execution of the contract possible in the first place and on whose observance the contractual partner may regularly rely, our liability is limited to the foreseeable, contract-typical damage at the time of conclusion of the contract.

10.3 Exclusion Any further liability – regardless of the legal nature of the asserted claim – is excluded.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can access at https://ec.europa.eu/consumers/odr.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

12.1 Applicable Law The law of the Federal Republic of Germany applies under exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers whose habitual residence at the time of the order is in another country, the applicability of mandatory legal provisions of that country remains unaffected by this choice of law.

12.2 Severability Clause Should individual provisions of these T&Cs be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by the statutory provisions.

12.3 Changes to the T&Cs We reserve the right to amend these T&Cs at any time with effect for the future. For contracts already concluded, the T&Cs valid at the time of conclusion of the contract apply.
