These Terms and Conditions (hereinafter “T&Cs”) apply to all orders placed by consumers through our online shop ergolea.de.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
These T&Cs apply to contracts for the sale and delivery of goods concluded between you as a customer and us as the seller.

The presentation of products in our online shop does not constitute a legally binding offer but is a non-binding invitation to submit an order.
By clicking the order button marked, for example, “Buy Now”, “Buy” or “Order with Obligation to Pay”, you submit a binding offer to conclude a purchase contract.
Before submitting your order, you can review and correct your details in the checkout process.
After submitting your order, you will receive an automatic order confirmation by email. This automatic confirmation documents receipt of your order but does not yet constitute acceptance of your contractual offer.
The purchase contract is concluded when we expressly accept your offer, for example by sending a shipping confirmation, by dispatching the goods or at the latest by delivering the goods.
The contract language is German and English.
Your order details and the version of these T&Cs applicable at the time of the order will be sent to you by email. We recommend that you save or print these documents for your records.
All prices shown in the online shop are final prices and include value-added tax where applicable, as well as any other price components that must be included in the displayed price.
In addition to the product price, shipping costs may apply.
Any applicable shipping costs are displayed transparently in the checkout before you place your order.
We currently deliver to:
Germany;
Austria; and
Switzerland.
Availability of delivery options may vary depending on the delivery address, product availability and logistics capacity.
Unless a different delivery time is stated on the relevant product page, in the checkout or in the order confirmation, the estimated delivery time is generally approximately 8–12 business days from dispatch.
Business days are Monday to Friday, excluding public holidays.
Delivery times are estimates and may vary depending on the destination, warehouse capacity, shipping route, carrier processing and customs handling where applicable.
Ergolea works with selected international logistics partners. Depending on stock availability, warehouse capacity and shipping routes, products may be dispatched from different logistics locations, including locations in Asia.
For some international shipments, import VAT, customs duties or other charges may be imposed by the competent customs authorities or delivery providers in the destination country.
Where such charges are legally applicable and not already included or collected during checkout, they are to be borne by the recipient.
For deliveries to Switzerland, import-related charges may apply under Swiss law.
When goods are shipped to consumers, the risk of accidental loss or accidental deterioration of the goods passes to the consumer only upon delivery of the goods to the consumer or to a person designated by the consumer.
The payment methods available for your order are displayed in the checkout.
Depending on the order and delivery destination, available payment methods may include:
credit card, including Visa, Mastercard and American Express;
PayPal;
Klarna;
Apple Pay;
Google Pay; and
Shopify Payments.
The purchase price is due for payment at the time specified in the checkout process or by the relevant payment provider.
If payment is delayed, the statutory provisions apply.
Consumers generally have a statutory right of withdrawal of fourteen (14) days.

To register a return, complaint or service request correctly and to avoid unnecessary follow-up questions, we ask customers to contact us first at:
Where possible, please complete our Return, Complaint & Service Form and include your order number.
After reviewing the relevant information, we will provide the appropriate next steps and, where applicable, the return instructions and the address of the responsible international return warehouse.
For technical issues, visible damage, stains, missing components, incorrect deliveries or suspected defects, we may ask for suitable photos and, where useful, a short video in order to assess the case efficiently.
In addition to statutory consumer rights, Ergolea offers a voluntary 90-Day Functional Defect Service from the date of delivery.
This service applies to verifiable product-related issues, including for example:
technical defects;
charging issues;
heat or vibration functions that do not work;
visible damage on delivery;
visible stains or contamination concerns present on delivery;
missing accessories or components;
incorrect deliveries; or
incomplete deliveries.
Depending on the individual case, an appropriate solution may include troubleshooting support, reshipment of a missing component, replacement, another suitable service solution, refund or partial refund where appropriate.
The 90-Day Functional Defect Service is not a general 90-day satisfaction-return policy.
It does not automatically apply where a customer simply no longer wishes to keep a product after the statutory withdrawal period has expired and no verifiable product-related issue exists.
This voluntary service does not limit statutory consumer rights.
The statutory right of withdrawal may not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery.
This does not affect statutory rights in the event of defective, damaged, incorrectly delivered or incomplete goods.
Returns are processed through the designated international return warehouse stated in our separate Returns, Withdrawal & 90-Day Functional Defect Service page.
For ordinary returns, the direct return-shipping costs are borne by the customer unless otherwise stated in the applicable withdrawal instructions, a specific offer or a separate agreement.
For damaged, defective, incorrectly delivered or incomplete goods, we review the individual case and determine the appropriate solution.
The statutory provisions on liability for defects apply.
If goods are defective, you may have statutory rights, including the right to request subsequent performance in accordance with the applicable law.
Depending on the circumstances, statutory remedies may include repair, replacement, reduction of the purchase price, withdrawal from the contract or damages.

To help us review the case quickly, please include your order number and, where possible, a short description of the issue together with suitable photos or videos.
Failure to report a defect promptly does not affect your statutory rights.
The delivered goods remain our property until the purchase price has been paid in full.
We are liable without limitation:
for injury to life, body or health resulting from an intentional or negligent breach of duty by us, our legal representatives or vicarious agents;
for damage caused by intent or gross negligence on our part, or on the part of our legal representatives or vicarious agents;
where we have assumed a guarantee;
where liability is mandatory under applicable product-liability law; and
in all other cases where liability cannot be excluded or limited by law.
In the event of a slightly negligent breach of a material contractual obligation, our liability is limited to the foreseeable damage typical for the contract at the time of conclusion of the contract.
Material contractual obligations are obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.
Any further liability is excluded to the extent permitted by applicable law.
We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers who have their habitual residence in another country, mandatory consumer-protection provisions of that country remain unaffected where they cannot be excluded by agreement.
Should any provision of these T&Cs be or become invalid, unenforceable or incomplete, the validity of the remaining provisions shall remain unaffected.
The applicable statutory provisions shall apply in place of the invalid, unenforceable or incomplete provision.
We may update these T&Cs with effect for future orders where necessary.
For orders already concluded, the version of the T&Cs valid at the time the contract was concluded shall apply.
